How to report illegal content, and how we handle reports.

Version 1.0 · In effect from 15 October 2026 · [Permanent link to this version](https://getlemma.io/legal/notice-and-action/2026-10-15)

## 1\. Scope and legal basis

1.1 This Policy implements our obligations as a hosting service and online platform under **Regulation (EU) 2022/2065 (the Digital Services Act, "DSA")**, in particular **Arts. 16, 17 and 18**.

1.2 It applies to any content hosted on Lemma that a User or another person believes is **illegal** — content that breaches EU law or the law of a Member State, including content that also breaches our [**Acceptable Use Policy**](https://getlemma.io/legal/acceptable-use). Copyright-specific reports are handled under the [**Copyright & IP Policy**](https://getlemma.io/legal/copyright), which cross-refers to this Policy for anything not specific to copyright.

1.3 This Policy applies alongside, not instead of, clause 12 of the [**Terms of Service**](https://getlemma.io/legal/terms) and the **Acceptable Use Policy**, which also let us act against content that breaches our own rules even where it is not illegal.

## 2\. How to submit a notice

2.1 Anyone — a User or a member of the public — can notify us of content they believe is illegal by emailing **[abuse@getlemma.io](mailto:abuse@getlemma.io)**. To count as a valid notice under **DSA Art. 16(2)**, please include:

2.1.1 a **sufficiently substantiated explanation** of the reasons why you consider the content illegal — not just an assertion that you don't like it, but why it breaches a specific law;

2.1.2 the **exact location** of the content — a URL, profile link, Session identifier, or another precise locator that lets us find it without guesswork;

2.1.3 **your name and email address**, so we can confirm receipt and follow up — **except** where the notice concerns an offence within **Arts. 3–7 of Directive 2011/93/EU** (child sexual abuse material and related offences), in which case you may submit the notice **anonymously**; and

2.1.4 a **statement confirming your good-faith belief** that the information and assessment provided are accurate and complete.

2.2 A notice that is missing clause 2.1.1 or 2.1.2 is unlikely to allow us to assess it and may be treated as insufficiently substantiated; we will tell you what is missing where we can identify a genuine report struggling to meet the standard.

2.3 You do not need a Lemma account to submit a notice.

2.4 **Reporting in the app.** If you have an account, every message and every profile has a **Report** control. It records the exact location automatically and identifies you through your account; you describe what happened. If you tick **"I believe this is illegal, not just against Lemma's rules"**, you are asked for the reasons it is illegal (at least a sentence) and for the good-faith statement in clause 2.1.4, so the report is a complete notice under **DSA Art. 16(2)**.

## 3\. What happens after you submit a notice

3.1 **Acknowledgement.** Where you gave contact details, we confirm receipt of your notice **without undue delay** (**DSA Art. 16(4)**). A report made in the app is acknowledged by email immediately, with a reference number.

3.2 **Assessment.** We assess the notice in a **timely, diligent, non-arbitrary and objective manner** (**DSA Art. 16(6)**). We look at the content against the law and, where relevant, against our own Acceptable Use Policy, and we may seek clarification from you if the notice is unclear.

3.3 **No automated moderation.** Every notice is reviewed by a person. We do not use automated tools to detect, assess or decide on content. If that changes, we will update this Policy and say so in each statement of reasons that relies on them.

3.4 **Decision and action.** Where we conclude content is illegal or breaches our rules, we act proportionately — which may mean removal, disabling access, restricting visibility, or account-level action under the **Terms of Service** and **Acceptable Use Policy**. Where we conclude it is not, we take no action. **In every case**, where you gave contact details, we tell you our decision without undue delay, and how you can seek redress against it (**DSA Art. 16(5)**).

## 4\. Statement of reasons (Art. 17)

4.1 Where we restrict a User's content or account as a result of a notice, or on our own initiative, and the User can be identified, we give that User a **statement of reasons** at the latest when the restriction takes effect. It includes:

4.1.1 **the restriction imposed**, including its **territorial scope** (Platform-wide, or limited to a jurisdiction) and its **temporal scope** (indefinite, time-limited, or pending appeal);

4.1.2 the **facts and circumstances** relied on in reaching the decision, including, where relevant, the nature of the notice that triggered it;

4.1.3 whether **automated means** were used in taking the decision, and if so, a description of them;

4.1.4 the **contractual or legal ground** relied on — the specific clause of the Terms of Service, the Acceptable Use Policy, or the law breached; and

4.1.5 **information on the redress available** to the User — the appeal in clause 5, out-of-court dispute settlement where applicable, and judicial redress.

4.3 The statement of reasons is sent by email to the address on the account when the restriction takes effect.

4.2 As a **micro/small enterprise**, the Company is currently exempt under **DSA Art. 19** from submitting statements of reasons to the Commission's Transparency Database (**DSA Art. 24(5)**). This exemption does not remove our obligation to give the statement of reasons to the individual affected User — that obligation applies in full regardless of company size.

## 5\. Appeals

5.1 A User affected by a decision under this Policy can appeal, free of charge, by writing to **[support@getlemma.io](mailto:support@getlemma.io)** within **6 months** of receiving the statement of reasons (the period in **DSA Art. 20(1)**, which we apply although the micro/small-enterprise exemption in Art. 19 currently covers us). A person who submitted a notice may use the same route to challenge our decision not to act.

5.2 Every appeal is decided by a **person**, not solely by an automated system, and we handle it in a timely, non-discriminatory and diligent way. If we got it wrong, we reverse the decision and restore the content or account.

5.3 **Where the restriction affects a Practitioner's ability to teach on the Platform, a human review is guaranteed before the restriction becomes permanent, and again on request in every case**, consistent with clause 12.4 of the **Terms of Service** and our readiness for **Directive (EU) 2024/2831** on platform work. There is no fully automated, unappealable path to losing your earnings on Lemma.

5.4 This appeal route is the same one described in clause 12.6 of the **Terms of Service** — they are not separate processes.

## 6\. Reinstatement

6.1 If your content was removed or restricted and you believe that was wrong, use the appeal in clause 5: write to [support@getlemma.io](mailto:support@getlemma.io) explaining why the content is lawful and complies with our rules. There is no separate counter-notice procedure; an appeal is how you ask us to reinstate content.

6.2 We review an appeal under the same standard as the original notice — timely, diligent, non-arbitrary and objective — and reinstate the content if the appeal is well-founded.

6.3 Where content was removed following a third party's notice, and we reinstate it, we tell the original notifier the outcome where we hold contact details for them and it is proportionate to do so.

## 7\. Misuse of the notice system

7.1 We may deprioritise, ignore, or restrict the ability to submit further notices from a notifier who **repeatedly submits notices or appeals that are manifestly unfounded** — for example, notices that misstate the applicable law, target content with no plausible illegality, or are used as a tool to harass a User rather than to report genuine illegality.

7.2 Before restricting a notifier's ability to report, we consider the number and pattern of manifestly unfounded submissions and give a warning where practical. We do not restrict a notifier merely for submitting notices we ultimately disagree with, where those notices were genuinely substantiated.

7.3 Misuse of the notice system by a User is also a breach of the **Acceptable Use Policy**.

## 8\. Reporting to law enforcement (Art. 18)

8.1 Where we become aware of information giving rise to a **suspicion that a criminal offence involving a threat to the life or safety of a person or persons has taken place, is taking place, or is likely to take place**, we promptly inform the law enforcement or judicial authorities of the Member State(s) concerned, or Europol, and provide the relevant information available to us (**DSA Art. 18**).

8.2 This applies regardless of whether a notice under clause 2 was ever submitted — it is triggered by our own awareness of the risk, from any source.

## 9\. Points of contact (Arts. 11 and 12)

9.1 **Authorities.** Our point of contact for Member State authorities, the European Commission and the European Board for Digital Services under **DSA Art. 11** is **[legal@getlemma.io](mailto:legal@getlemma.io)**. Our working languages for communication with these bodies are **English** and **Greek** (as **DSA Art. 11(3)** requires an official language of Cyprus); Russian is also accepted ([**Legal Notice**](https://getlemma.io/legal/notice), clause 4.3). We do not rely solely on automated tools for this communication (**DSA Art. 11(2)**).

9.2 **Users.** Our point of contact for Users under **DSA Art. 12** is **[support@getlemma.io](mailto:support@getlemma.io)**. This channel is monitored by our team and **is not solely automated** — every message reaches a person, and complex or contested matters are handled by a person, not resolved purely by an automated reply.

## 9A. Users in the United Kingdom

9A.1 If Lemma is offered to people in the UK, it is likely a regulated user-to-user service under the **Online Safety Act 2023** (users can message each other and meet in Sessions). UK users and anyone else can report illegal content using the routes in section 2; the same review, decision and appeal process applies.

## 10\. Legal representative (Art. 13)

10.1 **Art. 13**, which requires providers not established in the EU to appoint a legal representative in a Member State, **does not apply to us**. The Company is established in Cyprus, an EU Member State.
